PLANNING REQUIREMENTS
In accordance with § 7-725-a of New York Village Law, the Planning Board is authorized to
review and approve, approve with modifications, or disapprove all site plans for uses required by the
"Zoning Ordinance of the Village of Scotia, New York."
SITE PLAN APPROVAL § 250-59.1 - 250-59.11
Purposes and Review Criteria
It is the purpose of this site plan authorization procedure to provide a means for the village review of the criteria
listed in this section. Further, the Planning Board's review of each site plan application shall be guided.
APPLICATION AND TRANSMITTAL
Applications for site plan approval shall be filed with the Building Inspector and must include the material and
information as required by § 250-59.5.
Upon receipt of such complete application, the Building Inspector shall transmit 16 copies of such application
and material, which must be provided by the applicant, to the Planning Board. Applications must be submitted at least 12 days prior
to the regular meeting of the Planning Board. Every complete application for site plan approval shall be accompanied by a fee in the amount established
by the Village Board of Trustees.
MATERIAL TO BE SUBMITTED
Preliminary plans. Application for preliminary site plan approval shall be accompanied by the following information unless
expressly waived by the Planning Board:

Architectural review districts. The following areas shall be subject to the architectural review law and the
adopted design guidelines:
Central Business District:
The two Retail Commercial Districts, the General Business District and the Waterfront District that run along Route 5, as shown on the Zoning
Map of the Village of Scotia
SPECIAL USE PERMIT
No special use referred to throughout this chapter shall be conducted until a permit has been
obtained from the Board of Trustees.
STORMWATER MANAGEMENT AND EROSION AND SEDIMENT CONTROL
The purpose of this chapter is to establish minimum stormwater management requirements and controls to protect and
safeguard the general health, safety, and welfare of the public residing within this jurisdiction and to address the findings of fact above.

Application submittal 12 days before meeting date.
ZONING BOARD of APPEALS MEETINGS:
Fourth Monday of the Month @ 7:PM VILLAGE HALL
Application submittal 19 days before meeting date.

SOME DEFINITIONS:
AUTO WRECKING YARD
Any area or portion of any lot or plot, whether inside or outside of a building, for the temporary storage of
automobiles awaiting dismantling or the dismantled parts of automobiles or for the dismantling, cutting or demolition of automobiles.
BUILDING, ACCESSORY
A supplemental building, the use of which is incidental to that of a main or principal building and located on the same
lot therewith.
BUILDING HEIGHT
The vertical distance measured from the elevation of the finished grade at the front of the building to the highest point of the building.
BUILDING PERMIT
A permit to construct, reconstruct, enlarge or alter any building or other structure.
BUILDING, PRINCIPAL
A building in which is conducted the main or principal use of a lot on which said building is situated.
JUNKYARD
Any area or portion of any lot or plot, whether inside or outside of a building, for the storage, keeping or abandonment
of junk or scrap materials or the dismantling, demolition or abandonment of automobiles or other vehicles or machinery or parts thereof.
NONCONFORMING BUILDING
That part of a building or structure which does not conform to one or more of the applicable height, bulk or yard regulations
of this chapter, either at its original effective date or as a result of subsequent amendments hereto.
NONCONFORMING USE
Any use of a building or land lawfully established but which does not conform to the use regulations for the district in
which such use is located, either at the effective date of this chapter or as a result of subsequent amendments hereto.
OCCUPANCY CERTIFICATE
A permit to occupy or use any building or plot of land.
SETBACK
The distance from the street or lot line to the nearest building line permitted on a lot.
SIGN
Any device for visual communication that is used for the purpose of bringing the subject thereof to the attention of the
public, but not including a flag, badge or insignia of any government or government agency or of any civic, religious, patriotic, fraternal or similar organization.
SPECIAL USE
Any use outside the normal activity regularly allowed within a given district and for which a special permit is required.
SWIMMING POOL
Any structure intended for swimming or recreational bathing capable of containing water over 24 inches (610 mm) deep. This
includes in-ground, aboveground and on-ground swimming pools, hot tubs and spas. See “POOLS”
